In the state of Louisiana, can an act of donation to the person’s children of major age be done by the spouse who has Durable Power of Attorney?
Re: Power of attorney authority to donate
The power of attorney must specifically allow the sale and/or donation of the person’s property. A power of attorney which simply grants the power to “act on behalf of another” will not suffice.
