Power of Attorney
Is a Durable Power of Attorney the correct document to execute for a single man, no children, in the military as opposed to a General Power of attorney? I want my parents to be able to conduct business and make any decision necessary for me in case I cannot speak for myself or expire.

  1. Re: Power of Attorney
“Durable” means that the power of attorney continues to be good if you become incapacitated. “General” means that it is a broad power of attorney intended to cover anything and everything. You probably want a Durable General Power Of Attorney.

Additional points from your question: The durable power of attorney will cease if you “expire” . The personal representative appointed under your Will is the person that then steps in to handle wrapping up your business and financial affairs. Also, make sure that your durable power of attorney has powers for your attorney-in-fact to act as a healthcare surrogate to make medical decisions in the event that you are unable to do so.
