I have a homesteaded duplex and I rent to an unmarried couple with a child upstairs for more than two years now. I have given a Notice of Rent increase of $100.00 3 months in advance to cover costs for taxes and utilities. Right now I have a suspicion that they are preparing to move without any warning. Under Minn. §504B.135(a)(1999), Notice of tenancy at will to give a notice by law of termination within the 30 days of the month-to-month lease. See Oesterreicher v. Robertson, 245 N.W. 825 (Minn. 1932). They are low income renters, as well as my family. I have a pre-lease signed agreement and photographed documentaion of the unit prior to renting. What other course of action will I need to protect myself in case of concillation action, if they try to skip out or try to use the security deposit as the final rent? I know that a written notice from the renters must be given and that using the security deposit as rent is illegal and I can request for the demand for payment of rent for Dec. 2004. See MN. §504.20 subd. (7)(a) (1992). Will my suspicions be construed as constructive notice to vacate without a accepted waiver by verbal notice, or a written notice required by law? What is my full remedy? The damage is more than normal wear.

Do you know if under law a sixty day notice on a month to month lease is holdable? I am living in an unbearable situation of slum lord. Our building is infested with bed bugs, cockroaches, mice and unpleasant tenants. I’ve had two attempted break ins. The land lord also over charged me for late rent by 80 dollars.

I have given my notice of leaving but was told that I must give 60 days notice or I lose my deposit. This is a month to month lease, can I bring them to court also will it stand up in the court of law?

My brother was just given an eviction notice after about 15 years at his apt, and has to be out by 3-31-08. He is a month to month renter. He has been unemployed for over 1 year but has paid his rent. He was just diognosed with a heart condition. His landlord did not seem to have a problem until he mentioned his recent medical condition. What rights does my brother have? Can he be evicted without any reason? Will this hurt his chances of finding another place to rent?

Is the provision in a Hold Harmless Agreement that the Indemnitee hold harmless the Indemnitor for the sole negligence of the Indemnotor enforceable or deemed against public policy? As a General Liability underwriter I find it increasingly required that the Indemnitee furnish a Certificate of Insurance to the Indemnitor that the specific HH agreemnt is covered. This is particulary true of railraods and oil drilling and service companies with economic leverage over small contractors. I advise them not to enter ito these agreemnets but too often it is afer the fact.
