my adopted mother/grandma passed in may 2004, her son, my father, passed dec 2005. My adopted father passed in 1984. All had wills, and were probated, but I haven’t seen them, nor was I contacted after any death. I am the only child,and I have a daughter.There are condos still in mom’s name, and her son took $ 140,000 cash, 9 condo’s, heirloom jewelry, one pendant worth over $28,000 that she NEVER removed, he purchased a mobile home, a truck, a small boat, had a storage facility full of antique furniture etc., and a safety deposit box. I have been told by the executor that he was deeded my father’s, house, that he ”dug the grave himself” for my mother’s remains, that he new nothing of any of the other things, except that the truck was sold before my father died, and that even though I know there was lake side property in the next county, I only have $5000 from the estate. (He lived across the street form my father). I know my mother had a Lincoln Mach IV, when she died. The condos are handled by an atty in houston that refuses to respond to requests concerning the sale of units, still in mother’s name as of today. There were 4 units last year in her name, now only 2 according to public records. I need Help! Someone is lying !

I am executrix of our father’s will. Five siblings, one who is mentally challenged/epileptic. States in will he is to live in house till his death. Four of the siblings live out of town and/or out of state. I want to sell the house and use proceeds of sale to purchase a mobile home for above sibling and move to my home. He does not drive and requires medical attention. All siblings are in agreement to do this. What do I need to do? Our father died in 1996 and estate is still open.

Pay off on home & acquiring title
I own a mobile home which was totaled during a move. We received a settlement from an insurance company. We verbally negotiated a settlement with the finance company, which was lower than the actual pay off amount. We sent them a cashiers check, marked paid in full, which they accepted and cashed. Now they have refused to give title to the home and claim we still owe them a balance. They are a large corporation. If they accepted and cashed the check is that a binding settlement?
