Due to health reasons and no money I had to break my rental lease, my lease was up in June 2010, and I left the apartment in October 2009,my roomate was a 73 year old man with heart disease, kidney disease,(presently on dialysis), diabetes and coronary artery disease, he had to move in a senior home, I could not pay the rent myself because I am on social security disability and could not afford the rent alone, I tried to get someone to sublet the apartment but nobody was interested, please tell me how much trouble I am in, I am a breast cancer patient with heart disease and hypertension and asthma, my health is getting worse from the all the worry, I have to appear in court on Thursday November 19th, will I havae to go before a judge?

  1. generally when one breaks a lease or leaves before termination ofthe lease they are responsible for any loss of rent to the landlord during the remainder of the lease. Of course the landlord cannot stand idle he must make an effort to rent the property to reduce his damages. if he rents out the property for a monthly amount wihout a loss for some of the lease period then this is reduced from what is owed. Of course the lease may provide other relief or modify the damages. Have you tried to work something out with the landlord considering the ircumstances. Your roomate would also be responsible for the lease. best advice consult with an attorney to discuss your situation.
