stipulations of a general power of attorney
I will be out of the state when I am supposed to be in court for my ID divorce and it’s not possible for me to reschedule. Can I appoint a power of attorney to sign them on my behalf? I am the main complaintant, by the way.

    In the judicial district I practice in, only the attorney must be present for an ID divorce. I just make sure all parties have signed prior to the court date. I would caution however, that not all districts or Chancellors will allow this, particularly if children are involved. I would suggest you speak to your attorney. If you don’t have one, I suggest you hire one as soon as possible even if your spouse has an attorney. Decisions in Chancery Court can have drastic and possibly life-long effects.

    If this is a Pro Se Divorce, then you need to cancel either the court date or your trip. If the papers are not in proper form, the Judge will not sign.
