Documents Executed By General Power of Attorney
husband and wife are married. husband is military. husband executes general power of attorney and appoints wife attorney-in-fact. husband instructs wife to increase credit card balance temporarily and also to secure funds through signature loan that husband has. husband had accounts with bank prior to marriage. wife does as instructed. Wife was not on the accounts. Wife doesn’t remember how she signed the two documents executed. She believes she signed under GPOA and with her signature also to show who signed on behalf of principal per bank’s instructions. husband and wife divorced. In divorce proceedings, husband agreed, per divorce settlement agreement, that they were his separate debts. husband files bankruptcy; now bank is pursuing wife. Question: Need some kind of caselaw to research with similar circumstances or that at least touch on GPOA’s. Tried researching through internet using GPOA or attorney-in-fact or designated attorney. Do not get what I want. Already have RCW’s for Washington; now need caselaw. Please help!
