Understanding Chapter 7 Homestead Exemption
After a car accident in 1999, my husband and I have lived off of our credit cards, until they were maxed out. Currently the minimum payments are getting harder and harder to make, and we have fallen behind. We are looking into Chapter 7 filing, but are confused about the homestead exemption in KY. I used my $40,000 settlement to pay down our mobile home. It’s current value is $43,500 and I have a loan against it for $12,500. Would we lose our home if we filed Chapter 7? Our only other assets are a car valued at $2,500, with a lien on it to my father, and a truck valued at $200. Would we lose one or both of those vehicles under Chapter 7?

Hello.

Hello. My sister bought a mobile home for me this past year to which she said was “free and clear” to me, but yet she put her name on the title as well as mine. Now we are in a family spat and she is threatening to sell the home out from under me and my children. Is it legal for her to list this home for sale when I am on the title as well and do not agree to a sale?

What are the duties and powers of power of attorney, with respect to an elderly family member(care responsibilities of that elderly person) and the other children in the family.

Sell property with contract for deed pending
We bought a house on contract to deed. We pay interest free payments. Currently we have payed off half of the debt. We would like to move. But we would also like to be able to take some of what we have invested into the property. Can we sell the property provided we pay off the balance of the contract? Would our current deed holders have to be present for us to sell. Do most real estate agencies deal with situations like this often? (our contract to deed was signed and drawn up by their attorney)
