My mother has demenia and how do I go by making my brother and myself the power of attorney over her? She is 76 years old and my brother has been living with her for the past 5 years taking care of her. And we want to be able to have power of attorney over her. I live in one state and they are in another. She lives in Georgia and I am in Florida.

My mother has lung cancer spread to the brain. My sisters have both been living at home unemployed since before she became sick. Is there a way to get power of attorney through the courts. I believe my mothers funds are being transfered to their accounts. Checks are being forged to pay bills. We all take care of her.

As daughter to my elderly mother who will soon undergo surgery, my question is whether a duly executed Mass. Health Care Proxy dated in 2005 supercedes a Living Will Declaration dated in 2004 and a Medical Directive executed at the same time in 2004 both of which gives my older sister authority to act and make decisions otherwise granted to me in the 2005 Health Care Proxy. Which would a hospital follow. Also, is there any expiration to a Health Care Proxy; i.e. is the 2005 Proxy still valid without having been changed since 2005.??

1. Does some type of consent (for vent or DNR) need to be signed before a patient receives surgery? I do not know is the patient had a living will or advanced directives.

2. Should the hospital call the family after an emergency of cardiac arrest? Or is it okay for them to let a friend call the family?

3. Can a doctor refuse to transfer a patient upon the family’s request? The patient was stable.

4. Is it the responsibility of the family to call a hospital to get a transfer or the attending doctor taking care of the patient?
