I have a tenant who has no lease, he has been on a month to month basis. he is behind 800.00 to date. we drew up a payment arrangement with the stipulation if a payment was missed it resulted in a 48 hr. eviction, this agreement was notarized and signed by us both. can i have him vacate with this or would i still need a writ?

    The tenant can agree to vacate pursuant to agreement but if they resist you still need to do a UD.
    Is there a deposit available?
    Do you have all necessary collection info? Employer, bank, other assets or income?

    If the tenant refuses to vacate the premises, you must go through an eviction action to regain possession of the premises. You cannot legally do it yourself. If you have further questions regarding the eviction procedure, you can email me directly.
