Notice to quit after notice of moving out?!
Can a landlord evict you after you’ve sent him a thirty day notice that you’re moving out?

    The landlord can certainly serve you notice to quit and seek to collect back rent from you in Court. If there is no written lease, or you are on a month-to-month tenancy at will, and you do not owe any back rent then you shouldn’t have nothing to worry about.

    If you do have a written lease, and the term of that lease has not yet concluded, the analysis is different. In that case, the landlord can seek to collect the full amount of rent owed for the remainder of the lease. The landlord also must take reasonable steps to find a new tenant, or “mitigate” the damages he seeks from you in Court.

    You should talk to an attorney quickly to preserve your rights and negotiate a favorable conclusion to this matter.
