They won’t move
I leased a home for 6 months. After the lease expired, it just became a month to month as the lease was not removed. On December 2006, I informed the tenant in person that I needed the house back as my wife and I where moving back in. I told them that I needed the house by the end of Feb. 2007. I even told them that they did not have to pay the Feb.2007 rent in an effort to help them put a deposit on a new place. On Feb. 27, 2007, I visited the tenants and was informed that they were closing on a house within 10 days. I went back on March 8, 2007 and was told by that the house fell through and were getting another house in 2-3 days due to repairs. I visited them on March 11, 2007 and was told that they were not getting the house until March 20, 2007. They don’t seem to be in a hurry to move. I need the house asap. What should I do next? I feel that they were given enough notice to move and have been living their for free for all of Feb and now March.

    Oral notice is not sufficient. You must give them thirty days written notice that the lease is terminated. When those thirty days are up and they are still there, you give them a three day notice to vacate. If they don’t leave, file eviction.
