Not behind on mortgage, only credit cards
Divorced, quit claim deed from ex to me mortgage payments never late about $12000 credit card debt unable to pay. Income about $1200 month incl. child support tenant & pt job. Will I be able to carry on paying mortgage as I have been? Will I have to sell? Owe $39000 worth about $65000. Will my bankruptcy affect ex in any way? Don’t want him to know!

In–name removed–lawsuit that lasted over 3 years,–name removed–lis pendens was put upon–name removed–house which was then under the names of the parents and their only child – age 47 (who was in the civil lawsuit) After opposing counsel listed the lis pendens,–name removed–quit claim was done and the daughters name removed. The lawsuit continued and ended with an order for the daughter to pay opposing counsel fees and ex husband.

Daughter is now trying go bankrupt for all monies owed in the lawsuit. Does this constitute fraud? She lives in the house,they have owned and sold homes in the past always with all three names on the deed. They are not American citizens and the daughter has–name removed–green card.

Is this not fraudulent? Can they not put–name removed–lien against the house to get payment?

How can–name removed–European w–name removed–green card be allowed to go bankrupt when they haven’t contributed anything in the US?

Hello,

I was engaged to a man in Michigan and we purchased a home together in 2006. We never married, and lived in the home together for approximately two years, before he broke off the engagement. I moved out of the home, and relocated to Chicago, IL, without getting my name off the mortgage. He has been claiming that he has been unable to refinance the mortgage to get me off, for the past two years. Now he is telling me that he has to file bankruptcy because he is unable to make the mortgage payments and that the home is being foreclosed. I never signed a quit claim, nor have i paid a cent on the mortgage since I moved out. So on paper, I’m still a homeowner, with a mortgage, that lives in a different state.

What options do I have? I can’t make the mortgage payments – I have enough bills of my own, and I’d like to wash my hands of this whole business if possible at all – he claims the house won’t sell anytime soon. Any advice on the matter would be much appreciated. Thank you so much!

I was divorced last year and my ex-husband signed a quit claim deed on the house and land. His name is still on my mortgage as primary borrower. I am the secondary borrower. I have a very low rate on my mortgage and do not want to refinance to remove his name. He is now filing bankruptcy. I have been on time will all my mortgage payments. Question is, with him filing bankruptcy, can my mortgage company force me to refinance the mortgage? Or can I just go on making payments and keep his name on the original mortgage?

Can another person file a Chapter 7 on behalf of a debtor? Presume that the debtor is incapacitated, physically and mentally due to stroke, and the other person is the holder of debtor’s “General Durable Power of Attorney.” Will the “G.D.P.A” suffice, or must the debtor undergo a conservatorship on his behalf in order that the conservator file for debtor or would some other filing process be preferable?
