Real Property – Common Land
I live in a neighborhood of only million- dollar single family homes that have private property (a lot) and some coomon areas (only a tennis court) and some strips of land between houses that is common land owned by everyone. Question: Does the Association Board have the right to give a portion of that common land to enlarge his personal lot? For this answed assume the the Board does not have the power of attorney and there is nothing specific in the CCRs/Covenants/Conditions. One interesting but probably not a relevant issue – according to all documents – the association disolves in 2025.

I am being scammed by my former landlord.
I am being scammed by my former landlord. I lived in an apartment under a year lease for its duration. The landowner didn’t have any month to month leases so we signed a 6 month lease under a verbal agreement that it would act as month to month in order to move into a different unit in the complex, he assured us that as long as we gave him one month notice before we move we would get our deposit back. We moved after 3 months, and not only did he keep the deposit, he is asking us for the rest of the money for the 3 months on the lease. He is a lawyer. Can I sue him?

Lease Expiration/Renewal
My mom’s (85 yrs old) lease expired on Nov 30, 2005 and has not been renewed. Has she been technically renting month to month since then, and can she give a 30 day notice without penalty? Do all leases automatically go to month to month once they have expired? Can a landlord just white out the lease term on an existing lease form and put new dates in it, or do they have to print a new lease? When she asked them for a copy of her lease, it was then that they realized she didn’t have a current one, and they just changed the dates on the one that had expired. They are now claiming she has 6 months left and will not allow her to terminate without holding her to the 6 months. I believe they have mislead and taken advantage of her. She has been a tenant of theirs for 9 years!

how many days notice do we have to give the tenant to leave your property. There is alot of work that need done for that appartment, so i was wondering how many days notice do i have for them to leave the property. the lease is month to month. Thank you for your help

My tenants of 10 years separated (without my knowledge) during a month to month lease. Husband (sole provider) moved out without notice. Wife supported 100% by husband had trouble with rent for over one year. I was too nice, $4000 later, she moved out. He says he is not responsible because it was month to month and he moved out before rent became late or missing. He is only source of money and I say he never gave notice and he paid support covering rent. I have new address and SSN’s and his place of employment. Can I collect from him? She is not option as he still supports her in a new apartment. She signed paper while still married that said she owed $ and intended to pay. I would like to submit to collection agency if he is legally responsible. Is he?
