My roommmate and I were on a month to month lease and she moved out on April 17th (gave her 30 day notice, turned in her keys, and stopped rent payments). Now I am paying full rent for the apartment. I am scheduled to move out on April 28th (I already gave my 30 day notice). Since I am paying full rent, I have assumed the rental unit, correct? So the security deposit should be payable to only me and mailed back to me. I am delivering the apartment back to the landlord.

Is this correct?

There are additional details but above is my basic question. My former roommate also left significant belongings in the apartment and caused considerable damage as well. I assume that I can get rid of her things and repair the apartment as best I can before returning the apartment to the landlord. She cannot sue me for removing her things from the apartment, right?

We have been renting our house with a month to month agreement since September of 2002, the landlord/owner called us today and said we have to move out by April 1 so a relative can move in. I could understand if they were going to sell the house but our lives are being uprooted and now we have to relocate when we haven’t had a chance to save for the cost of moving. Is there any liabilirt on the owner/lanlords behalf to pay relocations costs?

Hi. I had a quick question. We verbally agreed to allow friends of the family to rent our rental property. They have moved their furniture in, but no lease has been signed yet as they left town for a few days. We recently found out that the boyfriend who will be living there is kind of a troublemaker and is always suing people and stuff.

We would like to not have them live there at all, but this boyfriend says that because of the verbal agreement there is no way he is leaving. The woman is very responsible and we have no doubt she will pay rent, however we are VERY concerned about this boyfriend. Since he is threatening with the verbal agreement we are planning on doing month to month lease with this couple, and hopefully ask them to leave when 2-3 months are up so that they have enough time to look for somewhere else to live. My question is, is it better to have this guy sign the lease along with the woman? OR is it better to just have HER on the lease? We just dont want to get tricked by this weasel, and we want to make sure our bases our covered. Any ideas would be so appreciated.

I was evicted because I was a month to month tenant and the landlord didn’t want me to stay there anymore. I stayed past the 60 days, and was subsequently evicted as I felt it was retaliatory; however, the judge only ordered that I get out, no monies, back rent or anything as I was not in arrears. Will this show up on my credit report even though I don’t owe any money.

I have been renting a house for 4 years (one year lease that rolled over to month to month) and without any notice by the owner, the owners informed us that they were selling the property immediately. This was done via a telephone call at 9:35 in the evening and followed up with a written notice of 30 to 60 days to vacate.

We moved as fast as possible and are in Escrow on a house.
– What rights do I have left, if any? – What are my rights now? We have accomodated open houses, individual showings of the house, termite inspections, etc. Now they want to do the extensive termite work while we are still there. – Do we have to let them do this work? Also, our 60 days ends Thanksgiving weekend but they want us out of there before that – like the day our escrow closes.
