Thirty Day Notice in for month to month lease
I am on month-to-month lease and served 30 days notice to my Appt manager in Sunnvale CA on July 16th, 2002. Since July has 31 days, my understanding is the 30 days notice will require me to pay rent till 14th Aug.( if you count 30 days including the day notice served) . I gave the notice during normal business hours 9-5 ( @ 2.00 PM). My Appt manager mentioned that the day notice is given is not included.Please advice. I appreciate your help and thanks a lot in advance. S. Kashikar

What rights do we have?
We rented a house for nearly three years. The landlords always verbally told us that they would not sell house until we moved and we told them what year that would be. They let us know they ”forgot” about a tax liablity and put the house on the market before end of the third year. We ended up moving due to the harrasment by realtor’s. We gave our landlord a 30-day notice, told them to keep the full deposit and had the house professionally cleaned before we moved out. They are taking up to Small Claims for 4500. They did no improvement to the house the whole time we lived there. We have never even seen them in person. They are billing us for the improvements to the house not to get ready to rerent, but for sale. Also is it true that if you are paying rent monthly after this long of a time that there is legal precedent that it is a month to month basis even with a lease? They changed the whole nature of our lease. We lost our right to quiet enjoyment of the property. Do we have any rights?

Tenants rights when being harrassed by another tenant
My fiance and I live in Glendale, Ca., in a 4 apartment building. Over 1 year ago a new tenant moved in and has been harrassing not only us, but the landlord as well. She was on a 1 year lease, but her lease expired in Oct. of ’06, and she is on a month to month basis. The landlord keeps saying she is planning to evict her for constant harrassment, but has done nothing. This woman is mentally ill, and has been harrassing us constantly.We live directly across from her. She has called the police on us 2 times, and has left us and the landlord disturbing letters. We have contacted the police to see what our options are and they keep telling us it is a civil matter. They also tell us it is the landlord’s responsibility to protect their property and tenants. I feel the landlord isn’t doing enough to protect our rights to a safe living enviornment and we do not know what to do anymore. We have lived in our apartment for over 5 years, and never had any problems with our other neighbors. I think this other tenant has done this sort of thing before, and has called the health dept, & city on the landlord to make her look like a slumlord to protect her place in the apt. But what about our rights?I feel the landlord isn’t doing enough for us

30 day notice when housemates don’t leave and associated fees
I am currently on a month to month lease and have 3 housemates. I gave my landlord a 30 day notice of intent to move. he refused the notice stating that because there were 4 of us living there that all of us would have to give notice and that i am still responsible for the rent and my deposit will not be refunded. how am i responsible for my housemates decision? and also he states that if we find another housemate to move in he will charge a $150 application fee to substitute them on the lease and that they would have to give me my deposit. can the landlord do this?

I have a 1 bed., 1 bath rental unit over my garage that I had rented to a
tenant with a 6 month lease that at the end of the 6 months became a ”month
to month” tenancy. I considered that to mean from the 1st of the month to
the end of the month. My tenant gave me notice on the 14th of a month that
he wanted to leave in 30 days. I explained that the reason I make it month to
month is that, in my experience, most applicants want a place to start their
tenancy at the beginning of a month and that it is difficult to find a tenant to
take a rental in the middle of the month. I said that if I could find a suitable
tenant to start mid-month, I would and his rent would end then, but I was
not able to. I found a tenant to take the place on the 1st of the next month.
He insisted it was in his right to leave mid-month and I disagree. I offered to
split the difference in lost rental. If he would absorb 1 weeks rent, I would
absorb the other week but he will not agree to this and insists he will only
pay to the 14th of the month. Could you provide the legal description of
”month to month rental” and give your opinion on this situation? Thank you,
