Tenant lease/Roomate question
I am currently on a month to month lease with someone. She has decided she wants her boyfriend to move in, however I would prefer that instead he does not move in and that she moves out and then I will sign a new lease with someone else. Can she or I start a new 12 month lease without the other one being able to stop it? Or since we are on the month to month lease, does the land lord have to ”kick one of us off ”of the current month to month lease before a new lease can be signed by either of us?

I rented a house on Sept. 22, 1994 on a month to month written lease. The rent was $1550.00/Mo. with a proviso that if rent was received prior to or on the due date, the amount would be reduced by $100.00. The original lease states that I paid $6300.00 to cover ”security deposit, pet deposit, cleaning deposit and key deposit”. Since this time, the rent has been increased twice and I am now paying $2050.00/Mo. I was given sixty (60) day notice to move on Dec. 1, 2003. Am I legally bound to pay the difference between the original monthly rent ($1450.00) and the current amount ($2050.00) as my landlord is requesting? It was a mutual understanding that $1450.00 of the original $6350.00 included last months’ rent as evidenced by the fact that the landlord is trying to collect the difference before we move out. Do I owe legally owe this balance? If not, is the original $1450.00 considered payment in full for last months’ rent?

Fee to Process pay or Quit Notice/Month to Month
Is it legal for my management company to charge me a $35.00 to process a 3 day notice to pay or quit after arrangements have been made including the paying overdo rent plus 10% late fee?

And do I have to sign another lease or can I legally go month to month. The last time I renewed because month to month was about $75 more /month.

1. I have a month-to-month rent of the apartment. At one point I had one rate, and later my rent was increased (no written notice). Then I know that rent rates when changing from month to month (mostly decreasing); however, my rent stayed the same. Whenever there is a change in rent rate (up or down) does landlord have to also bring rent rate up/down for all current residents (month-to-month), and not only for newcomers.

2. I moved into an apartment complex about two years ago. They provide their own telephone service (based on extentions), and they themselves use AT&T. When I moved in, I was provided only with local rates. A couple of weeks ago I started to make few international calls from time to time. Today I recieve a call from apt. manager saying that my phone bill is already $500.
Problem: AT&T charge $0.39/min; Apartment charged me ~$3.5/min (without providing me with any intl. rates beforehand, and without giving me any possible notice that I would be charged different rate from what AT&T charges, which they use).
Question: Can they do that?
