Damage done to tenants personal belongings
Seven months ago, I moved with my 2 small sons to a condo. At that time I listed all repairs that needed to be done to the condo, to just make it liveable, and sent it to my landlord. Every single appliance has broken down, and it takes days, often weeks, to get a response from him. The hot water heater has been an issue since day one, last month for 16 days I had no hot water. Despite my calls and letters, the landlord has put me off. Five nights ago, the water heater exploded, the fire department was here for 4 hours vacumming. My personal belongings were damaged, enyertainment center, couches, pictures, clothes, home video tapes…What are my rights? Do I have any? As of November 15th, we went on a month to month lease, but he told me 2 days ago that he was just going to sell the place. My heater doesn’t work either, I told him he needed to replace it, the water heater, and the carpet or padding, making it in a liveable state, then could give me a 30 day notice. Am I right? Meanwhile my things are sitting on soaked carpet, furthering it’s damage, he has done nothing to help. Please, help me!!

My Mother died 5-22-07 and was a tenant in an apartment complex. I’m not sure if she was on month to month or year lease, but think it was month to month. She was the only one one the rental agreement .The day she died my husband gave a 30 day notice to the manager- thinking it was the right thing to do. We then received a notice of pro-rated rent due for June. My mother died with no money, no will and no belongings. Also, her pension check and social security check will not be delivered for June, as I have informed them of the date of her death. She has $0 in her checking account and no savings account. Do I have a legal responsibility to pay her pro-rated rent for June- being that my husband gave the 30 day notice? She has a $500.00 security deposit with them, but that doesn’t cover the rent due. Plus the unit, which we have already cleaned of her belongings and straightened up, will need to be cleaned, carpets cleaned and walls painted. Thank you for your help in this matter.

When being terminated from a position as an Apartment Resident Manager can you be evicted immediately upon termination or must you be given 30 days just as if you were a month to month resident? Does it matter it you are paying no rent or some part of your rent or the length of time you have resided in the unit.

I was living in an apartment alone with my kids. I moved out and my ex-husband moved in with the kids. I put his name on the rental (month to month) with mine about 5 months ago. Went to give my 30 day notice and they said I am bound to the apartment complex until my ex-moves out…which he won’t…..what do I do?

I co-signed a month to month rental agreement. In the first month I got a job offer overseas and told the landlords that I’d be leaving at the end of the month, and asked to have my name removed from the agreement. Then they told me that they originally did not run a credit report for the other person since my credit was good enough. When they ran a credit report for the other party and found it unsatisfactory, they decided to keep my name on the agreement. I was not able to pursue the matter until it is resolved as the landlords went on a vacation and I moved out of the country. Now I have learned that the co-tenant received a 30-day notice and the matter might end in an eviction. I wrote to the landlords and asked to have my name removed and that I could not be held liable for any of the proceedings in writing. They responded by saying that they would not remove my name from the rental agreement. What are the legal implications of having my name on the rental agreement should it go into eviction? Would it affect my credit standing if the former co-tenant is evicted? Thank you.
