Inadequate cooling in home
I signed a month to month residential lease 1,400 month plus 1,450 first month rent. Went into the house the next day, very hot turned on the airconditoner, it never cooled off. Spoke with the landlord said I would not move in hardly any air coming out of ducts. He had a man come to check, called me said it was fine.
Went over the next day turned it on in am for 5 hours went back still hot.
Called landlord said I could not move in. He said it was adequate. Called air condioning Co. man came out did a check for adequate cooling of the house. He said the unit was too small and I would fry in the summer. The company documented this information.
I live in Palm Springs, very hot here!!! Called landlord, he said he would not upgrade the unit.
I never occupied the dwelling, he did give me back my deposit, but kept the $1,450. He told me the unit was working great when we were going over the lease.

I am leasing a town home in California to four college students for 1 year. 3 of the students want to break the lease and move out 5 months into the contract. 1 student will assume the full monthly rent. All four students are on the same contract. Do they forfeit their deposit?

My fiance and I share a lease with a roomate. We recently had to move out of state for family reasons. We have 2 plus years remaining on the lease that we cannot afford to pay. Our ex-roomate does not want to leave the property. How do we get out of paying 2 more years of rent without getting sued for the balance of the lease? If we stop paying rent, can we be evicted and would that mean that the landlord was terminating the contract? The roomate is unwilling to help us because she now has the house to herself and is paying a very small amount of rent. How do we get out of our obligation and avoid getting sued by the landlord and roomate? Is it at all possible to get the deposit back, of which we paid two thirds? What is our best course of action to lose the least amount of money? We are all equal partners on the lease.

In the October of 2005, my landlord w/out prior notice & w/out entered the basement of my single-unit, family home and filled it w/ his personal belongings for 4 mos. The rental lease does not stipulate that the property rented to me did not include the basement. I was not given any deduction in rent for this time period. Is it too late to file trespass and privacy damages in a civil suit? Additionally, the landlord keeps entering the private gardens of my residence without prior notice to butcher the trees in severe pruning and plant other trees. The most recent events occured in 9/2007 & Jan 2008. To date, some of the trees have not recovered from his severe pruning. I would like to sue for trespass and damages to the aesthetic appeal of the unit.
Would any of these events have merit?

I signed a rental lease for a ten month timeframe. It was to end August 18.. and so I wrote my check to reflect the partial portion of August. Recieved a phone call stating that I was required to supply a 30 day notice to vacate. Now I am being requested to provide funds for time that I won’t even be in the apartment. I never agreed to be in the apartment past August 18.. I feel as though this is a scam to keep my deposit. If I don’t pony up more money will they just use my deposit.. or will there be further problems down the road with them trying to collect even more! (there is another issue with this particular company .. which I guess I’ll ask about in another post perhaps). Thank you so much.
