Hi. I live in Santa Monica, CA. I am under rent control. I am on a month to month lease and gave my 30 days notice to terminate tenancy. The landlord said I have to give 60 days per my lease. Rent control regulations state I only have to give the same amount of notice as time between rent payments which for me is 30 days. Does the lease supercede rent control? Or am I only required to give 30 days notice? Thanks

Resident is on month to month. I non renew 30 day notice in august. september rent not paid, prior to 3 day quit, resident is arrested at property, now incarcerated, roomate still there. roomate is ”victim” of his child porn computer/picture accusations ( her daughter). She is moving, October rent now due, no certified notices were received by her, no mail key. He is awaiting trail, his possession in apartment, was advised he is not ever allowed on property again. ever! What do i do with his stuff? what forms to post at door, waiting period? Please help.

Trouble getting security deposit returned
A roommate and I leased an apartment for 1 yr. After the yr lease expired in Apr., our lease became month to month. I then gave 30 days notice to my roommate and my landlord that I was leaving – someone else was going to take over my place. My name on the lease was to be removed and put in her name and I wanted my security deposit returned to me. I spoke to my landlord and he said that he doesn’t get involved with sec. deposits when roommates switch and that I need to arrange for her to give it to me. She, and my former roommate agreed and saying they would give me my deposit when within a couple of weeks. Mistakingly, I let her move in without giving me the deposit, but because she was a friend I allowed it. Now, almost a month later after she has moved in, she still hasn’t given me a deposit and says that she doesn’t think she will be able to anytime soon. She’s saying that she has no legal responsibility to do so & that she is doing a favor to me. She claims that the only responsible one is the landlord, although he is also claiming no responsibility. All I know is someone owes me my money back but I’m not sure who I can legally demand to pay me. Any advice?

My girlfriend is moving out of our apartment which is a month to month lease. the manager asked me if i was leaving as well. i told them i wasn’t sure yet, but if i did leave it would be at the end of this month (the 29th). i found someone to live with me in the other room, and when i went down to inform the manager that i wanted to get the paperwork for them to fill out to get their credit run, they infromed me that they already had someone in line for the apartment and I couldn’t stay( that was today the 8th). I never said I was for sure leaving, and never gave my written 30 day notice. can they legally tell me I have to be out on the 29th when i never officially gave my 30 day notice?

My landlord gave me an eviction notice that I believe is not valid. I was late paying October rent and on October 6 gave me a termination notice to vacate by November 6.
I have been a tenant for just over a year and have heard that as a month to month tenant I’m entitled to a 60-day notice of termination. Even if that is not so, my rental is by calendar month so I believe a 30 day notice must be given for a complete calendar month, not a partial. So even if the October 6 termination notice is valid it would not be effective until November 30.
Where can I find out if the 60 day notice is a requirement, rather than a 30 day notice, and if the 30-day notice is sufficient time-wise, can it be done from the 6th of a month to the 6th of the next month as was done here.
Also, the landlord has told me in writing that if I’m not out by noon on the 6th that my belongings will be taken out of the house and placed in the front yard, the locks will be changed, and items left after 3 days considered abandoned and thrown away.
What are my rights in this situation?
