i have been living in my apartment since jan.2008 and my landlord has never once had me sign a lease agreement. i have recently lost my job in june 2009 and my fiance lost his job in may 2009. we have been trying to pay what we can of our rent and they have been accepting it until october 9, 2009 when they gave us a three day pay or quite in the amount of $3,380.00 then on october 13, 2009 they gave us a 30 day notice. but when they gave us the 3 day notice it was brought to me after 9:00 pm at night is any of this legal? can they procced with an eviction when they have nothing signed by me or my fiance.

Going against the lease agreement, in a BIG way!
Ok, where to start…..
I rent the back house, in a 2 address lot in Southern california. In June
they started to preform a re-model to the front house. The deadline was
supposed to be Oct. 1st and we were told that they would make the
construction as little of a burden on my family as possible. This is where
the story turns…
First it’s Dec. 1st. and the deadline seems nowhere in sight. The place is
completely gutted still, and I came to find out that my Garage had be
gutted as well, without my permisson, and they tore up the roof while all
my belonging sat below. It’s a mess…This was already getting me mad.
Then on monday, I wake up to find my entire walkway entrance to my
house was covered in piles of dirt. The dirt is from a fresh Ditch they dug
to lay new electrical wires. The ditch is right outside my door and is 4 ft.
deep. I have a 2 1/2 yr old daughter who I am now afraid to let outside,
because she could easily hurt herself. To make matters worse, I was
never notified that this was going to take place, and then i am told I have
to now enter my house from the contruction site, which by no means is
safe…

What Can I do?

Lease Agreement
I have a restaurant with a lease that says I can’t open another same type restaurant within two miles radius. I just signed a lease to open another restaurant within two miles, without remembering the clause. Now my current landlord is upset. What kind of legal action can he take against me?

Landlord Tenant
I live in a mobile home park. Utilities are individually metered, read by the park manager and a statement submitted each month noting lot rent and utility breakdown. According to the lease agreement, the landlord has the right to charge a 10% late charge on RENT. However, they apply the 10% to the utilities as well. It is my understanding that they cannot charge a late fee on utilities unless they (in turn) have to pay such a late fee. I see the possibility of a class action suit here. Am I correct?
