We moved into a house in June 25 2008. I just found out that the landlord has let the house go into foreclosure as a notice of default was filed on 2/27/2009. The landlord showed up today and left a notice to terminate month to month lease, that gives us 30 days to find a new place and move. Can he do that? It seems to me that we are still in a 1 year lease agreement until the end of June 2009. Most likely his foreclosure process will be over May 27 and he will no longer be the owner. Also it is my understanding that if we have been here a year he must give us 60 days not 30 days. Side note, landlord has been unreachable as our heating and AC unit went out in October, and the house has flooded numerous times from rain.

I have signed a 6 month lease that does not have any guarantees on it, I have now determined after a shooting down the street from my apartment, and the traffic and type of people coming in and out of it, that it is not safe for me, I am a 19 year old, very petite female. Is there any way to get out of my lease if I fear for my safety?

Can Security Deposit be taken as Last Month’s Rent?
When I moved in to my apartment, I signed a one-year lease agreement which indicates clearly that I had paid the ”first month’s rent”, a ”security and cleaning fee” deposit, and also a ”last month’s rent” (all exact terms). I moved out at the end of the lease but did not pay for the last month’s rent, assuming that I’ve already paid it upon moving in. Later, my landlord said I still owned him a 30 days rent, which he would subtract from my security deposit. To my understanding, according to California laws, landlords cannot use security deposit towards last month’s rent. My questions are:

(1) Especially in my case, the last month’s rent is prepaid, could my landlord use my security deposit towards last month’s rent, and if yes, what happened to the original last mont’s rent?

(2) The security deposit was more than one month rent, and I never received the remainder of it. Instead, more than a month after I moved out, I received a letter from my landlord demanding more money to pay for cleaning service. Is this legal?

What should I do in this case to recover my security deposit?

Landlord in fact made a different copy of our lease to suit her will. It is so obvious, you can see the copy marks. the dates of the lease and terms are now different. Can I sue the landlord

How will small claims court possibly rule
Tenant had an oven fire at my rental that was brought to my attention during a move out inspection.The fire department had to knock down the front since no one was home at time time of the fire. The tenant said the fire department told him over the phone that landlord was responsible.I contacted the fire department and requested a report on the incident. The fire chief called me and said the the report would state that they responded to a 911 call and when they arrived there was smoke coming out of the condo, and thet knocked down the door to gain entry and discovered an oven fire.The chief said the dept. would not take any sides in the matter and would list the fire as”undetermined.”The door and door frame were busted yet the tenant paid someone to patch and screw the door and frame back together. The door and frame clearly need to be replaced from the tenants security deposit. if the tent tries to recover in small claims court, what are the possible outcomes? And to add to this story
The tentant violated has lease agreement for drug activity.He lived in the unit for approx. 1 year. When he moved in the unit was completely renovated.He was a smoker. I had to repaint to removed smell. Do I have the legal right to remove smell.
