My girlfriend and I moved into an apartment in California with a roommate and signed a lease for a period of one year. The lease only converts to a month-to-month lease after the 1 year term has ended. Four months into the lease our roommate informs us that he has purchased a plane ticket back to NY and will be leaving in two weeks. To my knowledge, the roommate never informed the owner of this, but shortly after we were informed the roommate was leaving I did ask the building manager what to do about securing a new roommate and what paperwork would need to be taken care of for a new roommate to move in as we wanted to remain in the apartment. Two weeks later the roommate was gone, after having tried to skip out on rent for the final month he was there (rent is due on the 1st and he moved out on the 4th) and leaving a mess for us to clean up, no less. We had told him that we would refund his security deposit when a new roommate moved in and paid his or her own security deposit. He decided that we should keep it and put it towards the $700+ he still owed for his share of moving expenses that were never paid. It is now coming up on the due date for the next month’s rent and we do not have the funds to cover his share. What, if any, options do we have to collect payment for his share of the rent as per the lease agreement he signed?

Addendum conflicts with original lease
Page one of our lease agreement states that the term is 12 months spaning Jan 5th, 2002 – Jan 31st, 2003. This is actually 13 months. However, the addendum to our lease states that the ”one month free” concession is to be pro-rated over the term of the lease.
The calculation in the addendum was made over 12 months, not 13. They also over-charged us on our first-months rent because of incorrectly pro-rating the first month by 28 days, instead of 27.
The addendum does not specify how the calcultion was made, but any 10 year old can tell the difference between dividing by 12 and 13.
We would like to be out of the apartment by December 31st, or sooner if possible. Question: Do our rights change because of the incorrect calculations in the lease and addendum?

paid rent and 15 days later was locked out
I rented a room from a woman who was renting a house. On March 1 I moved in and paid her $1200 (rent and security deposit). On March 15 she took all of my things out of the house, piled them into the garage, and changed the locks. I called the sherrif for help but he told me that because I had not signed a lease agreement I had no rights. Is this right? I ask him to write a report but he siad no crime was committed so he would not. I then told the sherriff that the woman asaulted me and invaded my privacy and i wanted to file charges. I told him my webcam had recorded her going through my belongings in my room and her assault on me. I also showed him the busted door jam where she kicked in my locked door to get to me. But the sherriff would not respond to this. Instead he made us agree to the following: I was to come back in 2 days with a truck to take all of my things out of the house and at that point she was to give me back the $1200 i had paid her. I moved my things as i said i would but the woman has not given me a dime back. Small claims court will take care of my rent money and the damage to my furniture, but can still file charges for something that happened over two weeks ago? And do i have to deal with the same sherriff?

Living rent free was given to me by landlord out of kindness and was willing to put that in writing. Rent was filled out by landlord with term n/a. Landlord changed his mind, do I have right to stay there, till end of the lease?
