My husband and I owned a mobile home in Oklahoma. We received word that my husband was being transferred in his job. We immediately put our home up for sale. However, the home did not sell in time. We had to move out to Texas for the new job in July of ’04. Not knowing what to do, I had to just mail the house keys to the finance company, explaining our situation. They did resell the mobile home for approximately half of what was still owed on it. We were sent a letter on 8/’05 stating the balance due of $19,802.86. Not having the funds to repay any of this, we did nothing. We received another letter, dated 10/’06 reminding us of the deficiency. Under Texas laws, are they able to seize properties or take money from paychecks in an attempt to collect this debt?

Hello, I have been dealing with a debt collector for a car loan. I cosigned for car payment for my son and he has defaulted on the car loan. And refuses to pay for it. He has moved out of state and has made their reposession of the car even more difficult. I have however become disabled in the last 2 years and am now receiving disability SSD.

I am unable to make the 450 dollar a month car payments required. And the bank has threatened to sue to me. I have attempted to work with the bank to pay what I can but the bank is unsatisfied. Last month the bank told them if I payed them “500” dollars for 2 back payments they would cease and desist from legal actions.

However even after making that payment they have sent me a legal notice saying that they will be taking me to court if I cannot come up to 960 dollars by the 10th. Which they said they would not do. I was willing to work with the bank to what I could afford but they not satisfied with the results.

All I own is my mobile home. And I am scared to death that I will lose it if I get taken to court. I can’t file for bankruptcy for another year so I don’t know what to do. I have no assets other than my home and I am unable to work at this point. The bank is ignoring my son who is also on SSD and coming straight for me. In a year I do intend to file for bankruptcy but I have no choice until then. What options do I have?

Personal debt between individuals and the involvement of an employer.
My stepdaughter incurred a debt from a friend who happened to be a co-worker of her boyfriend. The funds were to be used to pay rent in which they had fallen behind. An agreement was signed stating that she would be the person to repay the debt. She has become pregnant and is not working at this time. Her boyfriend gave notice to quit in order to change jobs and was fired. He was then told that his former employer would be giving his check to the employee my stepdaughter owes the debt to, who would then pass the check onto the boyfriend in order for him to go to the bank, cash it and pay off the debt. The former co-worker feels that since my stepdaughter is not working that her debt then becomes the boyfriend’s. They are not married and have not been together enough time for a common law marriage so I feel the debt is still solely my stepdaughter’s responsibility. Am I right? Also I don’t feel it is legal for the employer to get involved since the debt arrangement was not made with the company, but an employee on a personal level. The employer should hand the paycheck over to the employee it is made out to. Am I correct? All parties are of legal age.

I have a dentist who owes me a refund on a credita card for work not done. I stoped seeing him midway through a dental procedure and had the work finished by another dentist. I had prepaid on a credit card for the whole procedure as he required me to do so befor he would treat me. I put a stop payment on the bill with my credit card co. He sent them a letter promiseing to refund half of the bill if I paid in full. He explained that he was entilled to half of the payment as he had done half of the work. I paid the bill in full with the CC co., now he ows me a one half refund back to my Credit card. Now he will not pay me unless I sign a hold harmless agreement. He told me this will make sure I do not say bad things about him to people. Any suggestions? I have not seen this agreement yet.
