30 day notification
I have recently found a house and have given the renter of my apartment notice. They replied that I must give thirty days of notice although my lease ends in about 2 weeks (April 30). In the state of Georgia, can they legally charge me a pro-rated, month to month fee for the remainder of the thirty day period that falls outside the termination of my lease on April 30? The 30 day period would end May 17. As well it is stated in the lease that thirty days of notice must be given.

Apartment Lease Early Termination
I have to break my apartment lease due to an out of state job relocation. I signed the lease on 01/18/09 and it ends 06/17/09. I have to move out by the end of Feb and on the contract there is an early move out clause penalty stating $735 which is one months rent. On the lease term, its states ”This lease contract will automatically renew month to month unless either party gives at least 60 days written notice of termination or intent to move out” Under these 2 clauses I assumed I would owe only $735 for breaking my lease early but I am told that I would owe 2 months rent ($1470) plus and additional $735 for the early move out penalty clause for a total of $2205. Is this legally justified even though it doesn’t say anywhere on the contract that I would owe 60 months rent? Is there anyway for me to break my lease and just pay one month rent penalty instead of 3 months worth?

I have a lease signed back on August 1st 2009 and it extends month to month until May 30, 2010. The lease clearly states that tenant or landlord may end agreement for any reason without cause by providing the other with a 30 day written notice of termination of lease. The lease does not mention anything about paying the remaining months or even paying one month. What am I obligated to pay if the lease does not state the regulations of what should be paid? I know Georgia law states that the tenant is bound by whatever is in the lease, but my lease just says to give a 30 day notice? Now I plan to send my 30 day notice when I send November rent.

I live in Atlanta, GA. My lease terminates at the end of September on the 31st. I contacted my landlord at the beginning of August requesting a renewal of the lease. However, the landlord did not respond until last week, saying she would not be renewing the lease. This has placed me in a very bad situation, giving me less than a month to find another place to live. There is a “Holdover” paragraph in my lease stating the lease will go to a month to month with an increase of 125% payment require of the the original rent. However, the owner is requesting that I leave the property by the end of the month. I need at least 30 days or the end of October in order to find another home. What are my options. Do I have to be out by September 31st, what are my rights in the situation according to Georgia Law.
