I live in PA and I just recieved eviction papers in the mail from the magistrate. On the papers the landlord wrote that I waived my notice to quit as per lease agreement. My problem is that I never signed a lease. I read that he has to post on my property that I have 30 days to move or pay(he never did this) and then he can go to the magistrate and file for eviction. Is this true, and if so what can I do about this? Doesn’t he have to provide proof to the court that he followed proper procedure before they give him a hearing date?

Ok, where to start…..
I rent the back house, in a 2 address lot in Southern california. In June
they started to preform a re-model to the front house. The deadline was
supposed to be Oct. 1st and we were told that they would make the
construction as little of a burden on my family as possible. This is where
the story turns…
First it’s Dec. 1st. and the deadline seems nowhere in sight. The place is
completely gutted still, and I came to find out that my Garage had be
gutted as well, without my permisson, and they tore up the roof while all
my belonging sat below. It’s a mess…This was already getting me mad.
Then on monday, I wake up to find my entire walkway entrance to my
house was covered in piles of dirt. The dirt is from a fresh Ditch they dug
to lay new electrical wires. The ditch is right outside my door and is 4 ft.
deep. I have a 2 1/2 yr old daughter who I am now afraid to let outside,
because she could easily hurt herself. To make matters worse, I was
never notified that this was going to take place, and then i am told I have
to now enter my house from the contruction site, which by no means is
safe…
What Can I do?

On a Thursday – week #1, I gave a deposit to a landlord to hold an apartment. The following Friday, I signed lease agreement and first months rent with required deposits (dog, common area deposits, etc.). Within 2 hours, notified apartment agent that I wanted to cancel agreement and not rent for the 6 month period. Agent informs me that the 3 day recission rule a)applies only to the initial deposit to hold the property (week #1) and, b)once the lease is signed the 3 day rule does not apply and I must give him the required notice (30 days, which essentially is the first month rent. Subsequent to our discussion after informing them of my desire to cancel… I put a stop payment on the check which prevented the cash movement. Any thoughts on my right to access the 3 day recission rule or other? Thanks.

My name is Brynn I was located in West Yarmouth and am having some issues with my roommate. I moved into the apartment February 12, and received a text message on March 2, stating that I have one day to move all of my belongings out. I rented a uhaul and moved everything out on March 5th, they are currently looking to get $1050 plus $600 for the 2 weeks that I was in the house. I never signed a lease agreement and was told that rent is $450 a month and now they are looking to get $1650. I wrote them a check for $600, which was February rent plus utilities, it wasn’t able to be cashed because of lack of funds, however I was forced into writing the check because they wouldn’t let me get my belongings out of the house until I wrote them a check. Now they want to go to the police and say I gave them a fraudulent check.They wouldn’t even let me get to my belongings for a week before all of this happened because they tried to withhold my belongings, it took me calling the Yarmouth Police Department to get legal advice from them about the situation. Now they sent a letter to my father demanding money from him, this is getting absolutely ridiculous and need some legal help and advice. Can someone please contact me and help me? I can’t afford a lawyer to help me in court and they are about to drain me out of $1650 for 2 weeks of living which is more then ridiculous! Is it legal for them to do this? to kick me out and try and charge me with all of this? Please someone help me out and give me some legal advice.
