Landlord wants rent for period after 30 day notice
On June 10 I gave my landlord a written notice stating that I intended to vacate the property on July 15. I pay my rent monthly on the first. They were on vacation July 1st so I deposited $250 into their bank account – the prorated portion for July 1 – 15. They now want an additional $250 plus $35 late fee for July 15-30 because they say they do not have to prorate the rent. My rental agreement says Ican give a 30-day notice at anyttime.

I also requested the landlord meet me to do a walk through before i turned in the keys (they never notified me of my right to a pre-move out inspect) and he stated everything was fine. Then i get a letter in the mail saying they are keeping my deposit for damage and cleaning – the house was empty when he did the walk through and he said everything was fine. I was never given the opportunity to correct anything that was wrong.

I don’t know what to do. Please help.

Lease agreement question
In December of 2005, my then boyfriend, his brother and myself moved into an apartment and signed a one-year lease. My dad co-signed for us. I went to rehab in mid-January and broke up with my boyfriend while in the hospital (he and his brother had drinking/ drug problems). I also told him I would not be returning to the apartment. I moved into a sober-living when released from the hospital and lived there for a year. When the landlord gave me a key to retrieve my things, she also gave me a paper to be signed by the guys releasing me from the lease. The brother wouldn’t sign it. They moved out of the apartment in May of 2006; I placed an ad on Craigslist and directed the new tenants to the landlord. My dad and I have since been receiving letter from the rental office’s lawyers saying we over $4,000 for breaking the lease. Tonight, my dad received a summons and I’m wondering what I should do. I have the documents stating I was in the hospital from 1/17/06 for over a month and then the rental agreement for the sober living. What else can I do? I’m freaking out and feel horrible my father is involved.

California Tenant’s release, waiver & indemnification
I am a potential tenant and the landlord has attached to the Rental Agreement a global release by T for all liability (including L’s negligence) and waiver of T’s right to sue.

Is this valid under CA law if I sign?
