Tenants wont leave my new home
I am about to close escrow on a home that still has tenants in it. The owner is renting to a family, who is also subleasing some of the rooms, that is being difficult. I was told that the house would be empty on 1/31/04 yet the tenants said they were not notified until 1/26/04 that the house had sold.We opened escrow in early December. The owner claims that he ”verbally” noticed the tennants. I am in the position that if I dont close escrow by 2/13/04 I will lose the locked in interest rate and be subject to more fees. I dont want to lose this house because of the stuborn tenants. The owner never had a written rental agreement with the tenants and it looks like I will be inheriting the property tenant occupied. What can I do to get them out ASAP? The owner claims he is trying to get them out but will not serve them. It has been suggested that before escrow closes that I enter into a rental agreement with the owner with the current tenants as tenants therefore making him responsible for rent and expenses and he says he is willing to do this. Or can I just serve the tenants a 60 day notice as soon as the home is mine? Please help!

Eviction
There is a person living on my property , we have no formal rental agreement only verbal. This tenet recently tried to kill himself by overdosing on medication. The tenet left his door open with his dog barking my son (who lives on the same property) wanted to go and play with the do like he normally does when to door is left open. I don’t like my children to disturb tenet so on this day I kept my son busy inside. About 20 minutes later I see the police and medical personal taking the tenet away. His mother have arrived and found him on the floor. They found medication and drugs in the room. His mother has told me that her son (the tenet) is unstable. He is behind in his rent and electricity. My biggest concern is the safety of my children. I hate to think what would have happened if my son had gone to the tenets and found him in this state. The tenets mother is planing to move him out in a month and a half but I would like to see him gone sooner. I there a way to evict someone who is a danger to children that takes less time then a normal eviction?

My wife and I rented an apartment 1 year ago from century 21.We signed a rental agreement for 1 year which has now expired.I found out later this apartment was not a legal two family dwelling.There was a tenant upstairs and now there is a tenant downstairs.For months now we have been complaining to the landlord that when the tenant downstairs uses his bathroom we get sewage smells.He has an illegal set up down there with a pump that pumps the sewage up and out.My wife and I have gotten sick 4 times this year with bacterial lung infections and bronchitis.We feel it is coming from these odors.The landlord comes and says he smells nothing and does nothing.Once he put chemicals down the sewage line ,it did not help for long.We want to move but can”t find a place for the rent we are paying now.I am also on a thin line at work from taking too much time off.I coudn”t help it tho I was real sick.What can I do.Since it isn”t legal and was rented to me like it was thru century 21 Do I have a law suit?I am sure sewage gases can be unhealthy.
