Lease Termination
On 2/1/07 we sent landlord notice that we would not be renewing lease. The landlord never provided us our copy of lease so we aren’t sure of exact lease end date. They say it expired 2/28/07. We are purchasing a home but haven’t found one yet. What are our rights for extending a month to month lease? Can they evict with no good cause?

Hi. I live in Santa Monica, CA. I am under rent control. I am on a month to month lease and gave my 30 days notice to terminate tenancy. The landlord said I have to give 60 days per my lease. Rent control regulations state I only have to give the same amount of notice as time between rent payments which for me is 30 days. Does the lease supercede rent control? Or am I only required to give 30 days notice? Thanks

My fiance got himself in a bad situation trying to help a couple he knows rent a house. He spoke with a Landlord he was acquainted with on their behalf. The Landlord verbally agreed to rent the house on a month to month basis and they moved in. Three weeks later my fiance visits and they are surprised by the Landlord with a Lease to sign. The Landlord threatens eviction if all 3 parties do not sign. He knew my fiance was not a Tenant, but insisted he sign because he knew him and not the new Tenants. My intimidated fiance signs to avoid his friends’ eviction. No one is provided a copy of the lease. Now the Landlord constantly harasses them all to collect his rent even before it’s due. Is it legal to surprise Tenants with a lease 3 weeks after moving in? What can my fiance do to get his name removed and avoid further liability? Is it legal to force someone to sign a lease knowing one signer was not to be a Tenant, and then not provide anyone with a copy of it? Do they have grounds for a harassment/fraud lawsuit against the Landlord? Please advise about this rental nightmare. Thank you.

URGENT!!!! No 30 day notice, I want to stay!
My girlfriend is moving out of our apartment which is a month to month lease. the manager asked me if i was leaving as well. i told them i wasn’t sure yet, but if i did leave it would be at the end of this month (the 29th). i found someone to live with me in the other room, and when i went down to inform the manager that i wanted to get the paperwork for them to fill out to get their credit run, they infromed me that they already had someone in line for the apartment and I couldn’t stay( that was today the 8th). I never said I was for sure leaving, and never gave my written 30 day notice. can they legally tell me I have to be out on the 29th when i never officially gave my 30 day notice?

I have a month to month tenant, (1 year lease expired in Feb 2009).

I have a month to month tenant, (1 year lease expired in Feb 2009). She gave me notice 3 days before September rent was due that she was moving. She told me to use the security deposit as last months rent and did not pay me for September.

I found out that I have failed to abide by the provisions of Fla.Stat. 83.49 waived my rights to make any claim on the security deposit.

Even so, would I be able to take her to small claims court for the rent money. She did not give me a months notice. If so what are my rights.
