I am in the process of getting a divorce from ”D”, who happens to have a susbstance abuse problem. I kicked him out of the house in 11/05 when he relapsed. He hasn’t paid any child support but agreed to continue paying the mortgage so both our only son (8 yrs old) could stay in the house. Come to find out, he lost it all (hasn’t worked since ’05) and never made a mortgage payment (his mother did). I also found out that the mother owned the house, my husband never did. In September, her lawyer sent us a notice to quit giving us 90 days…Since I get no financial help from the father (her son) it has been very difficult to find a house comparable to the one we live in. I may need more than 90 days!!! I can’t afford to pay my in-laws any $ as I’m trying to save for the down payment. Under these circumstances, do we have any rights? Could we stay longer? Also, during the aforementioned 90 days, my brother-in-law bought the house from his mother…is the original notice to quit issued by the mother and her lawyer still valid even if the property has a different owner or should a new notice to quit have been executed ?

Hi. My last remaining parent recently passed and the estate would like to sell their house. Unfortunately, a family member has lived there for years (rent free) and is not in any hurry to vacate. We tried to have the police make him leave, but they would not get involved, calling it a civil matter. Anyway, do I have to use summary process and serve him with a notice to quit? He never paid rent, but he’s lived there for many years (over 20 as adult), with parents up until about a year ago. It seems like he was never really a ”tenant,” per se.

Security Deposit
I received a 30 day notice to quit after renting an apartment for over 2 years. The house was being sold. Because I have a child I inquired about tenants rights, just in case I did not find another apartment within that time frame. While reading this information I discovered that a landlord is required to supply you with bank and interest information. The person I rented from did not comply with this requirement. Additionally the new owners claim that my security deposit was not given to them. When I contacted the former he disputed the fact and sent me a copy of the sale agreement which has an amount but no detail of the breakdown. We did move within the demanded time but neither past or current owner will give me a straight / documented answer. What are my recourses and can I hold both parties liable for failing to abide by the security deposit disclosue?
