As a landlord I don’t require a written lease agreement but I do verbally ask for thirty days notice if the tenant moves out. I tell them they wil not get their deposit back if they fail to comply. I am now being sued in small claims court because a tenant moved in Oct 1 and then told me they were going to move out three weeks later (Oct 24) because they bought a trailer and is moving out Oct 31 and now wants their deposit back. Do they have a case? If so, what do I need to do? Can I countersue for Nov rent?
