I have a tenant who has been renting from me for 3 years and at each annual renewal he fails to sign and send back lease agreement. Do I have an enforcable contract or lease agreement?
You have a month-to-month tenancy. Either party may terminate the tenancy by giving 30 days written notice to the other. You do not have an enforceable contract or lease other than as stated until both parties sign a formal lease agreement.
