legal rights question
i have been cohabitating with a man for the past year and a half, and when we refinanced his property, i was listed as coborrower and added to the deed. we had obviously intended to have a future together and put an addition to the existing structure. although many improvements have been made, it seems at this point that we have irreconsilable differences and he has asked me to leave. i realize i can quit claim to the deed but what about the mortgage? and just what rights do i have to stay if the house is in both of our names? can i be evicted? if my name is the only name that carries any debt made from the improvements made to the house, on my credit cards, am i responsible for paying the debt off myself as he reaps the benefits of the debt in the house after i leave? please inform me of what rights i have concerning the matter and any advice as to what i might do to rectify the situation. thank you

    I just settled the exact same case. Quitclaiming your interest does not get you off the mortgage. You need legal advice to make sure you receive reimbursement for the improvements you made and perhaps a share of the house depending upon the time you lived together.
    He can’t evict you but he can seek a Petition to Quiet Title to get you off the deed. It is a complicated matter. Call an attorney who does this type of work.
