If your appartment lease is up and you have not renewed the lease, you are intitle to move out at the end of the lease correct without being penilized? they are telling us we will not get our deposit back and they will sue us for the rent.

    It depends upon the terms of the lease. Some lease agreements have self renewing clauses that say something to the effect of this lease will automatically renew unless you give notice at 60 (or 90 or some other number) days prior to the expiration that you do not intend to renew it and will be vacating the premises at the end of the current term of the lease. If your lease has such a clause, there may be penalties at this time although a judge might find the clause void and rule against the landlord in a lawsuit.

    You should consult an attorney and have the attorney review the lease and advise you of your legal rights and obligations.
