30 day notice to move because the landlord is selling
We have a 1 year lease on our duplex which is not up until June of 2003. We were just given a 30 day notice to quit due to the landlord putting the duplex up for sale. Is this a violation of our lease? Is there any law in California about this that can give us more time before we have to move?

    The only way that you can be asked to move i this circumstance is if there a clause in the lease that says that the lease can be terminated on sale of the property. This, however, is normally at the request of the new buyer, not the seller.

    It would make sense that when one is selling an investment property, like a duplex, he would want tenants in the property. That normally makes investment property more valuable.

    You lease is valid until its date of termination. You cannot be evicted on a 30 day notice. If an eviction is filed, please contact me and fax me your documetation. I can help you.
