In an estate under $600,000 that would not be taxable, would the will need to be probated? Would it be advisable to make a Living Will or put the estate in trust?

    Yes, probate would be necessary. It can easily cost thousands and take years. Many people choose to avoid these problems with a living or revocable trust. Attorneys charge from $1000 to $3000 to work with estate planning clients.

    Whether an estate is taxable is irrelevant in determining what probate procedures may be necessary. A Living Will has effect only during the maker’s life time and will be of no help in terms of the probate of his/her estate. You are advised to immediately seek the advice of a qualfied estate lawyer in your area before proceeding further.
