Eviction
landlord gave us 30 days notice to vacate premises so that he can remove old home and put new home on same property. He stated that it will take approximately 5 wks and that he wants us to return and continue being month to month tenants. I have written landlord asking for him to put this in writing along with how much rent will be once home is completed. I also asked him for a letter of reference(incase we are asked for one). To date I have heard nothing from him. We are having difficulty finding another place to live within the school district. We have 3 children and 2 dogs. What rights do we have if we do not find another home by May1st? Shouldn’t he have given us more than 30 days notice since we have 3 children, 2 dogs and have lived here for almost 5 yrs?

    If you do not have a written lease, the landlord must only give 30 days notice to vacate. However, if you do not vacate, he will have to petition the court for an eviction and you can go to court and ask the Judge for addtl time to move.
