Summary Rating Determination
I received a letter for my Permanent Disability Rating of 26% for my RSI. Stating payments would commence w/in 14days after date of last payment of temp disability indemnity. Which was issued last June. Now I called my companies WC ins. carrier they said I should have been paid this whole time. Also, my company was just sold 2days ago, so now they are talking about a Compromise & Release. It seems everyone is in aggreement of my disability rating, I was just wondering what I am entitled to for my future medical, how long does this process take & should I retain an attorney? I am confused as to why I was informed about this 6mo. after the fact and more importantly what is the best course of action for me to take. Thanks

    Actually I think in inappropriate for an attorney to guarantee an increase in your recovery. In your case, there are substantial penalty issues which benefit not only yourself, but an attorney, for the attorney gets a portion of any penalty and any settlement. Since the case is ready to settle with an undisputed rating, most of the work has already been done. Ask your attorney to take 5% and see what happens? You can always contact the Information and assistance office at the DIR home page, but an attorney is probably your best option at this point because of the penalty issues.
