Minors and Contracts
Im a licensed car dealer in Florida…I sold a 1995 Camaro to a lady and her 16-year old son about a year ago ”as-is” with no warranties. She recently returned and said she wanted to return the car on the grounds that since we had titled and licensed the car under her son’s name (at her request) the contract was void since he was a minor at the time of the sale. Although she did’nt sign any paperwork, she filled out all the forms in her own handwriting, instructed her son to sign them, paid for the car herself and requested a lien be placed on the car in her favor since she was loaning him the money. Her son entered into the agreement with her obviously implied consent. However, she is a paralegal herself and has already moved for a hearing and final judgement to rescind the contract and refund the money. Should I go to court and explain the situation to the judge or is a lawyer necessary? I have copies of all the paperwork including the ”as-is” statement and bill of sale completed by the mother in her own handwriting. There are no DMV laws or regulations permiting the transfer of ownership of motor vehicles to minors.

Over a year ago I purchased over 50 accounts from a lawn care company. And, since last april, the owner has been going door to door, and taking some of these accounts back. Some include condos, schools, and churches costing me to lose over $16,000.00 in revenue these past few months. I have no idea what I should OR can do about this. I have the bill of sale and a list of all the accounts I purchased as well. I don’t know if this is considered illegal or not. And, I’d like to know before I even consider taking legal action.

I financed my used car in Florida. The day I signed my bill of sell and traded in my old car and drove off the lot with my new (used) car my bill of sell said 18% interest. The dealership called me the next day and made me come in and sign another bill of sell with financing for 24.35% I would like to see if I could sue under the fair lending act or in plain english being pushed into a corner and not having my old car (trade in) so I felt I had to sign the new bill of sale? is there a lawsuit out there a lawyer would assist with me? also do I sue my financing company or the delearship? for knowing my old car was already traded in and making me sign a new bill of sale (contract)

My son purchased a motorcycle from a private party in Orlando in December 2007. The bike’s total cost was $5800.00. My son gave the guy $4,000 upfront and got a bill of sale and a contract stating that my son would pay $125/month and the balance at the end of June, 2008. My son lost his job and was two months behind in payments. He let the seller know and was told that he could pay the balance in June. In late March, the seller came to my son’s garage and took the bike back, citing non-payment. Evidently my son was intimidated and allowed the man to take the bike. Now that he has the money he wants to settle up and get the bike, but cannot get ahold of this man. This seller will not return my son’s phone calls. We do not know Florida law. What should he do? Thanks.

Bankruptcy. Quit Claim Deed
Can you please help me with this problem. I filed a quit claim deed back in June 2004, transfering my home to my parents.It was recorded in court in September 04. I filed for Chapter 7 Bankruptcy in June 2006, and everything was discharged in November 2006. Last month I tried to refinance my mortgage, and transfer the property back to my name. I found out that there is a lien on the house from one of the creditors that was included in the Bankruptcy. The new mortgage company will not approve the loan unless I pay this 10K to the creditor that has a lien on the property. The lien was filed in November 2005, 14 months after the quit claim was recorded. Can they legally have a lien on the house even though its been 3 years since the quit clain deed was done ?, and the bankruptcy was filed over 2 years later. Please help me, I just want to get my life back in order, and get my home back in my name. Thanks for your help.
