quit claim deed
My partner and I owned a house. We have since broken up and she agreed to let me buy her out of the house. She signed a quit claim deed to transfer her interest in the property to me. Consideration was for half of the mortgage (we were both on the mortgage and owed $300,000 and half of the equity which was about $100,000 which is $200,000 total consideration. I refinanced the house to give her her share of the equity ($50,000). Now the house is in my name and so is the new mortgage. Now she wants to reverse or void the quit claim because I have not given her the $50,000 yet. I will give it to her in the near future. Can she have the quit claim deed voided or reversed because she didn’t get all of the consideration yet?

Lifetime Lease
A few years ago my mother signed a quit claim for property in Florida to me & wife. After that she worried that I would sell it so to calm her we typed out and signed a ”lifetime lease” that stated she had a place to stay as long as she was alive. She is now 85 and not in good health and I feel she needs to be back in Indiana where her doctors are close by. She does not pay anything towards the place in Florida but states that ”piece of paper” gives her legal rights to the property. What are my rights and other than keeping my mother ”calm”, does she have any claim to this property?

If you record a quit claim deed due to marriage and there is an existing mortgage on the property do you still have to note the amount of the mortgage on the DR219 and pay the intangible mortgage tax when recording the QCD?
