lease agreement/withholding rent
i and a roommate filled out application to an apartment, i signed the lease with the landlord but roomate did not, however her name and job is on the lease with out her knowing about it, thats how she never got to sign the lease,who is responsible for the lease agreement. also i’m withholding rent for june and july i have been living here since 12/2007 i was promised to have apartment fixed before move i but it was noti took pictures. of mold floods, main doors open at my apartment leaving it unsafe and no lock on my balcony window, now the land lady is suing me for non-oayment of rent

Recently sent registered letter lease to tenant; returned undelivered. Prior to mailing lease had both tenants read lease on my PC. It was a year’s lease agreement. Since moving in and paying 1st month’s rent, tenant called on 12th of month asking, “where’s the frigging lease” and, later in the conversation mentioning he hadn’t sent the check, but I would receive it by end of week, even if he had to send it express overnight mail. The check didn’t arrive Friday or Saturday and Monday’s a holiday-the 18th. My plan is to send the “good” tenant a “month to month” lease instead of the original lease they read on my PC. Is there an implied “lease” contract for the original year’s lease, or, because the tenants ignored the post office’s repeated attempts to get the tenant’s to sign for the registered letter either at the door or at the post office, can I now send the tenant/s a month-to-month lease to sign? Also, if they refuse to sign a month-to-month lease does that automatically place them on a month to month rental basis. Note: state of agreement-New Jersey. Any advice will be welcomed. Thank you.

In our lease agreement it clearly states that if the rent is paid after the 5th day of the month a $10.00 late fee will be added to the rent each additional day it is late. They have paid the rent, but still owe a $50.00 late fee, and are refusing to pay it. Therefore, I do not consider the rent to be paid in full. Is this grounds for eviction and if so, what do I do to get them out?

We have been staying as tenants since 3 yrs. The landlord uses a portion beside ours and both portions have common electric meter. We were unaware of this and were paying the total bill. Whenever it used to be huge, we used to ask the landlord but she used to bluff us that only we are using it. On the whole she did a fraud of 25000/- INR. How can we get back our money? There is no lease agreement.

my landlord is trying to evict me for late rent and just gave me only a piece of paper from a notebook stating that it is a notice to vacate before a certain date and she didn’t even give a clear date. She said if we didn’t move by that date our stuff would be put out on the curb. We don’t have the money to move and she still hasn’t given us a lease agreement since we moved in last month and we haven’t been able to turn our gas on because of it. what should we do?
