Moving out after expired lease
Our lease expired and prior to the end of the lease we gave a verbal commitment to sign another lease. It states in the agreement that we must give 60 days notice prior to moving out. Three months after this verbal commitment, and one month after lease expiration we had still not recieved a new lease, there is no month to month clause in our agreement. We paid for the month after the lease, then two of my roomates decided that they no longer wanted to sign a new lease and moved out. I could no longer afford the rent myself and moved out as well after giving 1 months notice. The landlord refuses to return the security deposit saying that we did not give 60 days notice. However our original agreement was fulfilled and she accepted money from us for rent after the completion of our original lease. Can we get our security deposit back and how do we go about it?

I have rented an apt in my home in Central Islip NY to a married couple with two young kids (5-8). They were shown the apt by a rental agent and were interviewed by myself and seemed ok i was a bit uneasy but i needed the money. So they moved in from a shelter on 10-25-07. I had them sign a month to month lease but neglected to state that there should be no illegal substances in or near the premises. i have smelled them smoking joints in the apt and witnessed the same in the back yard, in addition during the initial interview the husband neglected to inform me that he was just released from prison for ATT CRIM SALE CONTR SUBSTANCE 3RD class C. As if that wasn’t enough while away visiting family my spouse called me very upset and told me that ”he beat his wife so bad in the apt. that she ran to our door begging for respit and mild medical attention in the form of ice packs and band aids” this took place around 4am 11-14-07. A few days before the alleged incident of domestic violence i notified the couple that they were on ”thin ice” and that our home was to remain drug and violence free. After the aformentioned incident a 30 day noticed was presented 2 them but they refused to sign the paper. What is the next course of action?

Eviction
landlord gave us 30 days notice to vacate premises so that he can remove old home and put new home on same property. He stated that it will take approximately 5 wks and that he wants us to return and continue being month to month tenants. I have written landlord asking for him to put this in writing along with how much rent will be once home is completed. I also asked him for a letter of reference(incase we are asked for one). To date I have heard nothing from him. We are having difficulty finding another place to live within the school district. We have 3 children and 2 dogs. What rights do we have if we do not find another home by May1st? Shouldn’t he have given us more than 30 days notice since we have 3 children, 2 dogs and have lived here for almost 5 yrs?

I intend to launch a web based small press & young writer’s workshop. Content will be provided by self, select individuals and submissions from young writers. In an effort to minimize costs, I would like to structure it as a sole propriotorship. My only reservations concern liability etc. Would providing a terms of use clause, restrictions, and indemnifications protect me personally? Or am I placing myself at risk in the event that some individual finds content problematic or what ever unforseeable complaint that may arise? How may a sole propratore protect himself ? Or is it not possilbe?
