Warranty Deed Protection
We bought a mobile home 15 yrs ago and got a notorized Warranty Deed and now that we are trying to finalize a sale of the property a deed issues arose during the title search. We have been told we will need to quiet the deed and will need to put $5000 in escrow for the lawyer. Does the Warranty Deed protect us and make the person who sold us the mobile home financially responsible and if yes, if the man is no longer alive, is his spouse, who signed the deed also, responsible to clear up the title issue?     Depending upon what the title defect is, a waaranty deed is a warranty that title is good. If the spouse signed the deed she should also be liable. When you purchased the home, did you get title insurance?
    Regardless, get your own lawyer; these things can be complicated.
