what can I do if I beleive the solicitor who is the executor of a will to which I am the beneficiary is and has not performed specific duties. These solicitors are supposed to have sent a letter of indemnity to an insurance company in the UK in order that the policy monies be released to me. I have spoken to the insurance company who tell me that these documents are still awaited, despite the fact that I went to a court in cyprus and got these done and gave them to the solicitors back in august 2006. But it has been over a year that these solicitors knew about the policy. Now I cant reach them by phone for the last two weeks. Also is it a legal formality that when monies came into the solicitors to pay off things the solicitors without asking changed the currency and took monies without telling me and no bill was given to me.

    The executors of a Will have a legal duty of care towards beneficiaries. This duty is particularly strict when the executors are professionals such as solicitors.

    It would seem very clear that these executors have failed in their duty to carry out the testators wishes towards you as a beneficiary As such they can be liable to you in damages and be ordered by the court to comply with their duties.
